Terms of Service

1. Parties and scope

These terms are between you (or the entity you represent) and Searchalong AI. They govern access to the platform hosted at https://searchalong.xyz and all associated features, APIs, and content.

2. Eligibility

You must be at least 18 and legally authorized to bind the entity you sign up on behalf of. If you use the service on behalf of a company, “you” means that company and each authorized user of its account.

3. Account and access

You are responsible for the actions taken from your account and for keeping your credentials confidential. Notify hello@searchalong.xyz promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms.

4. Acceptable use

• No attempts to bypass authentication, rate limits, quotas, or usage caps.
• No scraping, reverse engineering, or reselling the platform's output as your own service.
• No unlawful, harassing, defamatory, or infringing content.
• No use of the platform to generate spam or to enrich third-party advertising models.
• No probing our infrastructure for vulnerabilities outside our disclosed responsible-disclosure channel.

5. Subscriptions, billing, and cancellation

Paid plans (Starter, Growth, Scale) auto-renew at the interval displayed on https://searchalong.xyz/pricing at time of purchase. All fees are in USD. You may cancel from your dashboard billing panel at any time; cancellation stops the next renewal and you retain access through the current billing period. Free-tier features remain accessible after cancellation. Failed payments trigger a 14-day grace period; unresolved failures at day 15 result in downgrade to the free tier.

6. Refunds

Refund requests within 7 days of your first paid charge are honored in full when the product materially fails to perform as described. Later refund requests are considered case by case. Email hello@searchalong.xyz.

7. Service availability

We target 99% monthly uptime but do not offer a formal SLA on non-enterprise plans. Third-party AI engines (ChatGPT, Claude, Perplexity, Gemini, Google AI Overview) may be independently unavailable; when they are, the affected engine is reported as unavailable in your workspace and its data is excluded from that day's score computation. Enterprise plans may include a written SLA on request.

8. Intellectual property

You retain ownership of the content you provide (brand information, prompts, competitor lists). The platform, its underlying code, its aggregate analytics, and its design remain the property of Searchalong AI. You may reuse the scorecards and reports we generate for you inside your own marketing surfaces with attribution not required but appreciated.

9. Feedback

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use it to improve the product. We are under no obligation to keep feedback confidential or to implement it.

10. Warranty disclaimer

The service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the results generated by AI engines are accurate, complete, or suitable for any particular purpose. Your use of the service is at your own risk.

11. Limitation of liability

To the maximum extent allowed by applicable law, our aggregate liability arising from your use of the service is limited to the fees you paid us in the 90 days preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost data, or third-party engine outages.

12. Indemnification

You agree to indemnify and hold harmless Searchalong AI, its officers, and its contractors from claims arising out of your misuse of the service, violation of these terms, or violation of any third-party rights, including intellectual property or privacy rights.

13. Termination

You may close your account at any time from the dashboard. We may suspend or terminate your access with notice for breach of these terms, non-payment, or as required by law. On termination, sections 8 (IP), 10 (warranty), 11 (liability), 12 (indemnity), and 16 (disputes) survive.

14. Force majeure

Neither party is liable for delays or failures caused by events outside its reasonable control, including internet outages, third-party engine unavailability, natural disasters, or government actions.

15. Changes to these terms

We may update these terms; material changes are surfaced by email or in-product notice at least 30 days before taking effect. Your continued use after the effective date constitutes acceptance.

16. Governing law and disputes

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Any dispute arising from these terms or the service will be resolved first through good-faith negotiation. If unresolved after 30 days, the dispute will be submitted to binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, seated in New York, New York. Notwithstanding the foregoing, either party may seek injunctive relief in court to protect intellectual property rights.

17. Class-action waiver

To the maximum extent allowed by law, you agree that disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative proceeding.

18. Miscellaneous

These terms, together with the Privacy Policy, are the entire agreement between you and Searchalong AI on this subject. If any provision is unenforceable, the rest remains in effect. Neither party may assign these terms without the other's consent, except in connection with a merger, acquisition, or sale of assets.
